Terms of Service

The short version: you pay for parallel streams, tokens aren't metered, you own your prompts and outputs, we don't store or train on them, subscriptions renew until you cancel, and you agree to use the service responsibly. The full terms below are what apply.

1.The agreement#

These terms are an agreement between you and Keep Pushing Forward Ltd (“we”, “us”) for using NeverMetered: the website, dashboard and API (together, the “service”). By creating an account, creating an API key or using the API, you accept these terms, the Acceptable Use Policy and the Refund Policy. The Privacy Policy explains how we handle personal data.

If you use the service for a company or other organisation, you accept these terms on its behalf and confirm you are allowed to do so. “You” then means that organisation.

2.Eligibility and your account#

  • You must be at least 16 to create an account, and at least 18 (or the age of majority where you live) to buy a plan.
  • Give accurate sign-up details and keep your email address up to date: we send security, billing and policy notices there.
  • One free allowance per person. Don't create multiple accounts to get more free requests.
  • You are responsible for your API keys and for all activity under your account and keys, including usage by anyone you share them with. Keep keys secret, revoke any key you think has leaked, and tell us promptly about unauthorised use.

3.The service and “unlimited tokens”#

NeverMetered gives you access to open-weight language models through OpenAI- and Anthropic-compatible APIs. Plans are priced by parallel streams (how many generations can run at the same time), not by tokens.

“Unlimited tokens” means we don't meter or charge per token and there is no monthly token quota. It does not mean unlimited capacity. Every plan is subject to:

  • its parallel-stream limit and queue allowance (requests beyond them are rejected with a 429 error);
  • a maximum number of output tokens per request and a maximum duration per stream;
  • fair-share queueing when the platform is busy, which may delay requests; and
  • the Acceptable Use Policy.

We may add, replace or retire models and engines and tune limits to keep the service fast and fair. If we materially reduce what a paid plan includes, we'll tell you in advance, and the change applies from your next renewal unless it's needed for security, legal or abuse reasons.

No uptime guarantee. We work hard to keep the service available and fast, but it is provided on a best-effort basis without a service level agreement. Maintenance, outages and queueing can happen.

4.Free tier#

  • Accounts without a paid plan currently get 10 free generation requests per UTC day. Free requests need a verified email address.
  • The allowance is per person: it is shared between accounts used from the same browser or device and between accounts calling from the same network.
  • We may change, limit or withdraw the free tier at any time, for everyone or for individual accounts (for example, if we detect abuse).

5.Plans, payment and cancellation#

  • Subscriptions are billed in advance, monthly or yearly, and renew automatically until cancelled. Prices are in US dollars and exclude taxes, which are calculated at checkout and added where applicable.
  • Passes are one-time purchases that give a plan's limits for a fixed number of days. They don't renew. Buying another pass for the same plan extends the end date.
  • Payments are processed by Stripe. We never see or store your full card details.
  • Changing plans: upgrades take effect immediately with a prorated charge; downgrades take effect at the end of the current billing period.
  • Cancelling: cancel any time from the billing portal in your dashboard. You keep access until the end of the period you've paid for. Refunds are covered by the Refund Policy.
  • Failed payments: if a renewal payment fails, Stripe retries it. Your plan stays active for a grace period of 3 days after the period ends; if payment still hasn't succeeded, paid access ends and your account returns to the free tier.
  • Price changes apply to new purchases. Existing subscriptions keep their price; if we ever need to move one to a higher price, we'll email you at least 14 days before your next renewal so you can cancel first.
  • If you dispute a charge with your bank, we may suspend paid access and free requests on the account until the dispute is resolved.

6.Your content and model outputs#

You own your content. As between you and us, you keep all rights in the prompts, files and other input you send (“inputs”) and in the responses the models generate for you (“outputs”). You give us only the limited permission needed to process inputs and return outputs to you.

We don't store or train on it. Prompts and outputs are processed in memory to serve your requests and are not written to our database or logs, and we never use them to train models. The Privacy Policy explains the details, including the short-lived caches that make follow-up requests faster.

You are responsible for your inputs: you must have the rights to send them, and they must comply with the law and the Acceptable Use Policy.

Outputs can be wrong. Language models can produce inaccurate, incomplete, offensive or insecure output, and similar output may be generated for other users. Review outputs before relying on them, especially code you run and anything with legal, medical, financial or safety consequences.

Model licences. The models are published by third parties under their own licences, some of which include use restrictions. By using a model you agree to follow its licence. We can tell you which licence applies to a model on request.

7.Confidentiality and security#

We treat your inputs and outputs as confidential and access them only as needed to run the service, and we protect your account data with reasonable technical and organisational measures: TLS in transit, API keys stored only as hashes, and engine credentials encrypted at rest. No system is perfectly secure, and we'll notify you without undue delay if we become aware of a breach affecting your data.

8.Suspension and termination#

You can stop using the service at any time. To close your account, email legal@nevermetered.com; cancel any subscription first so it doesn't renew.

We may throttle, revoke keys, suspend or close accounts if you breach these terms or the Acceptable Use Policy, if your use puts the service or other users at risk, if payment fails, or if the law requires it. Where reasonable we'll warn you first and give you a chance to fix the problem, but we may act immediately for serious or repeated violations. If we close your account without cause, we'll refund the unused part of any prepaid period.

We may discontinue the service as a whole with at least 30 days' notice, refunding the unused part of any prepaid period.

9.Disclaimers#

Except as expressly stated in these terms, the service and all outputs are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. Nothing in these terms excludes rights you have under consumer law that can't be excluded.

10.Limitation of liability#

To the extent permitted by law, neither party is liable for indirect, incidental, special or consequential losses, or for lost profits, revenue, data or goodwill. Our total liability for all claims relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim arose and USD 100.

These limits don't apply to liability that can't be limited by law, such as for death or personal injury caused by negligence, or for fraud.

11.Indemnity#

If you use the service for business purposes, you will defend and indemnify Keep Pushing Forward Ltd against third-party claims arising from your inputs, your use of outputs, or your breach of these terms or the Acceptable Use Policy, including reasonable legal costs. This section doesn't apply to consumers.

12.Changes to these terms#

We may update these terms. For material changes we'll email account holders at least 14 days before they take effect, and the “Last updated” date above will change. If you don't agree to the new terms, cancel before they take effect; continuing to use the service afterwards means you accept them. Changes needed for legal or security reasons may take effect sooner.

13.Governing law and general terms#

  • These terms are governed by the laws of the country where Keep Pushing Forward Ltd is established, and its courts have jurisdiction, except that consumers keep the protection of the mandatory laws and courts of the country where they live.
  • If any part of these terms is unenforceable, the rest stays in effect. Not enforcing a term straight away doesn't waive it.
  • You may not transfer these terms without our consent; we may transfer them as part of a merger, acquisition or sale of the service, with notice to you.
  • These terms and the policies they reference are the entire agreement between us about the service.
